Most of our collision files come off a handful of roads. Highway 401 cuts straight through the middle of North York and is the busiest stretch of highway in North America, with Allen Road and Highway 400 feeding into it. Running north and south are Jane, Keele, Dufferin, Bathurst and Yonge. Running east and west are Finch, Sheppard, Steeles, Lawrence and Wilson. We then request the records from whichever hospital treated you, because those records are what the claim is built on. Ontario injury law, in four rules
A few rules shape every North York injury claim, and knowing them early protects you.

Deadlines are shorter than you think
You generally have 2 years from the day you knew or ought to have known you had a claim, which is usually the day of the injury, to start a lawsuit. Some notice periods are much shorter: 60 days written notice for a fall on snow or ice, 10 days for a fall on a municipal sidewalk in disrepair, and 120 days to give notice of a car accident lawsuit. - 02
Car accident claims changed on July 1, 2026
Most accident benefits, including income replacement, became optional purchases rather than mandatory coverage. Eligibility for the optional benefits was narrowed. And auto insurance now pays first for medical claims, so your own extended health or employer coverage is no longer drawn down first. What you can claim depends on the coverage the policy actually bought. - 03
The deductible nobody mentions
Pain and suffering awards in car accident cases face a deductible of $47,913.01 in 2026, which disappears if the award is high enough. Slip and fall and dog bite claims have no such deductible. - 04
Denied benefits are not the end
Insurer denials can be disputed at the Licence Appeal Tribunal, and many denials do not survive a proper challenge. Do not take a denial letter as the final word.
