Yes. You do not need to own a vehicle or hold your own insurance to file an accident benefits claim. Section 268 of the Insurance Act sets the order for a struck pedestrian: your own insurer first if you are insured under a policy, for example a household policy naming you, then the insurer of the vehicle that struck you, then any other vehicle involved, then the Motor Vehicle Accident Claims Fund.
