Traumatic brain injury (TBI) results from external force, whether impact, jolt, or penetration. Acquired brain injury (ABI) is the broader category, including injuries from oxygen deprivation, stroke, and medical events. Severity is classified at the acute stage using loss of consciousness, post-traumatic amnesia, and the Glasgow Coma Scale (scores of 3 to 8 indicate severe TBI, 9 to 12 moderate, and 13 to 15 mild). The classification describes the moment of injury, not the life that follows.

Mild TBI and concussion involve no or brief loss of consciousness and often normal imaging. They are still capable of producing post-concussion syndrome: persistent headaches, cognitive fog, memory and concentration deficits, sensitivity to light and noise, sleep disruption, irritability, anxiety, and depression.

Moderate TBI involves longer unconsciousness and amnesia, frequently positive imaging, and lasting cognitive, behavioural, and physical deficits requiring structured rehabilitation. Severe TBI involves extended coma, major structural injury, and life-altering outcomes demanding lifelong, funded care.

The rest of the list did change. Income replacement, non-earner and caregiver benefits, housekeeping and home maintenance, and death and funeral benefits became optional purchases, and eligibility for them was narrowed at the same time. Those are the benefits that turn on the coverage bought on the policy.

The decisive battle is the catastrophic impairment designation. Severe brain injury meeting the SABS criteria raises the limit to $1,000,000 combined for medical, rehabilitation, and attendant care benefits for life. Case management comes with it, paid out of the medical and rehabilitation benefits rather than bought as coverage. Insurers contest these designations with their own assessors, and in *Zvonkin v Aviva* (2026 LAT) a catastrophic claim failed precisely because the applicant's physician never personally assessed the claimant and relied on an occupational therapist's ratings instead. We contest back with the full medical-legal record, as in *Pleta v TD* (2026 LAT), where the Tribunal awarded attendant care at the $6,000 per month catastrophic maximum and approved an iPad as a funded cognitive aid, and we take denials to the Licence Appeal Tribunal.

Stream 2 is the tort claim against the at-fault driver, property owner, or other negligent party. It covers pain and suffering, past and future income loss including diminished earning capacity, and future care costs built on life-care plans. Housekeeping and home maintenance capacity and housing modifications are claimed alongside, and Family Law Act claims run in parallel for spouses, children, and parents.

Stream 3 is the other coverage that runs alongside. Long-term disability, employer benefits, CPP disability, and private coverage interact with the streams above. Coordinating them so they add rather than offset is part of every file.
