The 10-day deadline

Under the Municipal Act, 2001, anyone planning to sue the City of Toronto or another municipality on the basis that a sidewalk or road was not kept in repair must give written notice within 10 days of the incident. In Toronto the equivalent provision sits in the City of Toronto Act, 2006. Failure to give proper notice can defeat the claim entirely.
A snow or ice injury on private property runs on a separate 60-day written notice under section 6.1 of the Occupiers' Liability Act, and a snow or ice claim against a municipality must also clear the gross negligence standard.
