Whatever vehicle was involved, the framework is the same. Ontario operates a no-fault auto insurance system layered with a tort claim against the at-fault driver. Your own policy provides Statutory Accident Benefits (SABS) regardless of who caused the crash. The tort claim provides additional recovery for pain and suffering, future income loss, and other heads of damages — subject to Ontario's verbal threshold and deductible.

  • What should I do immediately after a vehicle accident in Toronto?
    Seek medical attention, even if injuries seem minor. Call police if there is significant damage or injury — Ontario requires a report for damage over $2,000. Photograph the scene, the vehicles, and your injuries. Get the other driver's insurance and contact information. Report the accident to your own insurer within 7 days. Then call a personal injury lawyer before signing anything from the insurer.
  • How long do I have to file a vehicle accident claim in Ontario?
    The general tort limitation under the Limitations Act, 2002 is 2 years from the date of the accident. SABS applications should typically be submitted within 30 days. For accidents involving municipal vehicles or city-maintained roads, a 10-day notice requirement may apply. Earlier action is always better — evidence preservation, witness availability, and medical documentation all benefit from prompt legal involvement.
  • What is SABS and do I qualify even if the accident wasn't my fault?
    SABS (Statutory Accident Benefits Schedule) is Ontario's no-fault accident benefits system. Every Ontario auto policy includes SABS coverage. You are entitled to SABS benefits regardless of who caused the accident — including income replacement, medical and rehabilitation, attendant care, and other benefits. SABS is separate from the tort claim against the at-fault driver.
  • How much is my vehicle accident claim worth?
    Vehicle accident settlements vary enormously based on injury severity, occupation, age, fault apportionment, and insurance coverage available. Minor soft-tissue cases may produce $25,000–$75,000 settlements. Serious fractures and chronic pain cases reach $100,000–$500,000. Catastrophic injuries with permanent disability can exceed $1 million. The first consultation gives you a realistic range based on your specific facts.
  • What does it cost to hire a vehicle accident lawyer at VC Lawyers?
    All vehicle accident cases are handled on contingency — no fee unless we recover. The contingency percentage is set in writing at the start, typically 25%–33% depending on complexity and stage of resolution. Disbursements (medical records, expert reports, court fees) are advanced by the firm and recovered from the settlement. The first 30-minute consultation is free.
  • What if the at-fault driver was uninsured or underinsured?
    Your own Ontario auto policy includes uninsured automobile coverage ($200,000 minimum). If you carry the OPCF 44 endorsement, your underinsured motorist coverage extends to your full third-party liability limit (often $1 million or $2 million). Hit-and-run cases also fall under uninsured motorist coverage. We coordinate these layers with your tort claim to maximize total recovery.
  • Can I claim if I was partially at fault for the accident?
    Yes. Ontario follows the comparative negligence principle under the Negligence Act. Even if you were partially responsible, you can still recover damages — your recovery is reduced by your percentage of fault. A claimant 25% at fault recovers 75% of damages. Our job is to argue for the lowest defensible fault percentage and to push back on inflated insurer fault assessments.
