What the law provides, and how fast it runs

Ontario's framework for these claims runs through Part V of the Family Law Act. Under it, the spouse, children, grandchildren, parents, grandparents, and siblings of the deceased are each entitled to bring their own claim against those whose negligence caused the death.

Those claims cover the loss of care, guidance, and companionship the family would have received. They cover the loss of financial support the deceased would have provided, the "dependency" claim that is central where the person lost was a family breadwinner. They also cover the value of household and caregiving services now gone, the expenses incurred during any period between injury and death, and funeral costs.

Alongside the family's claims, the estate may bring its own claim under the Trustee Act. In motor vehicle deaths, the Statutory Accident Benefits Schedule adds a no-fault layer, which means benefits that get paid no matter who caused the crash. Since July 1, 2026, that layer has to be read carefully. Death and funeral benefits became optional purchases. The lump sum to the spouse and to each dependant, and the contribution to funeral costs, are paid only if the car insurance policy responding to the crash bought that coverage. If it did not, those two benefits are not available, and we tell you that early rather than let your family plan around them. Medical and rehabilitation coverage did stay mandatory on every policy. So a surviving relative can claim counselling under it, but only if that relative is an insured person under a policy and the death has caused them a psychological injury. That is a claim you have to make, and sometimes fight for, and it does not replace the death benefit. If the policy bought no death or funeral coverage, your family's recovery runs through the Family Law Act claim against the driver at fault. Whatever benefits the policy does carry are paid no matter who was at fault, and they are separate from the lawsuit.

Under Ontario's Negligence Act, families may still recover even where the deceased was partially responsible for the accident. The award is adjusted, not erased.

Two truths shape how these cases must be run. The first is that time does not pause for grief. The general limitation period is 2 years from the date of death, but insurance notice periods after a fatal accident can be as short as 7 days. Fatal-collision evidence decays in days, including reconstruction, camera footage, and witness memory, and inquest and investigation processes run on their own clocks.

The second is that the family should never face the insurers alone. Defendants and their insurers treat fatal claims as financial matters from the first phone call. Our job is to carry that fight so the family can carry each other.

Fatal accidents in North York: the claims behind the losses

The causes are the ones our practice sees every day, at their most final. Fatal collisions on the 401, the 400, and Allen Road. Pedestrians killed on the wide arterials of Finch, Sheppard, and Steeles, disproportionately seniors and disproportionately in darkness. Motorcyclists and cyclists who never made it home.

Truck and commercial vehicle deaths run along the freight corridors. Impaired and hit-and-run deaths bring criminal proceedings beside the civil claim, with unidentified-driver coverage answering when the driver fled. Then come transit fatalities, fatal falls and premises deaths, and workplace fatalities in the industrial corridors, where the workplace regime, third-party claims, and Ministry of Labour proceedings interlock.

Each mechanism carries its own defendants, deadlines, and evidence. Each, properly handled, carries the same outcome: accountability, and a family's future secured.

The claims, explained plainly

Loss of care, guidance, and companionship. Ontario law compensates each eligible family member for the loss of the relationship itself: the guidance a parent would have given, the companionship of a spouse, the presence of a child.

Courts assess these within ranges shaped by precedent, individually assessed for each relative, and honest counsel will tell you they are measured rather than enormous. We claim them fully for every eligible family member, and we never let them stand in for the larger claims below.

The dependency claim, or loss of financial support. Where the deceased earned income the family relied on, the law compensates the support that would have flowed across their whole working life. That means income, benefits, pension accrual, and the trajectory their career would have taken, all calculated with actuarial and economic evidence, net of contingencies, year by year into the future.

For a family that lost its breadwinner, this is typically the largest component of the claim. It is also the one most often underbuilt by firms that don't do this work.

Loss of household and caregiving services. A parent's childcare, a spouse's caregiving, and the home management and labour the deceased performed are all replaceable only at market cost, and all claimable at it. For a lost stay-at-home parent, this claim can rival a dependency claim in size, and it is even more often overlooked.

The estate's claim and the expenses. Under the Trustee Act, the estate claims the deceased's losses between injury and death and the related expenses. The family claims funeral and burial costs, travel, and out-of-pocket losses through the worst weeks of their lives.

The no-fault layer. In motor vehicle deaths, SABS death benefits flow to the spouse and each dependant and funeral benefits help with the immediate costs, where the policy bought that coverage, because both became optional purchases in 2026. Medical and rehabilitation coverage remained mandatory, and a surviving relative who is an insured person under a policy and who has suffered a psychological injury from the death can claim counselling under it. Whatever the policy carries is paid regardless of fault, on application, and separate from the lawsuit. We file in the first days, so that whatever support is available reaches your family while the claim itself is still being built.

The no-fault benefits in detail, because they arrive first

In motor vehicle deaths, the Statutory Accident Benefits Schedule provides a layer of support that is too often left unclaimed in the fog of the first weeks.

Since July 1, 2026, the death and funeral benefits described here are optional purchases, under narrowed eligibility. A family whose policy bought them has them. Where the policy did not, those two benefits will not be paid, and we would rather tell you that in the first week than have you find it out later. In that situation the Schedule has no substitute to offer, and the family's recovery runs through the Family Law Act claim against the driver at fault, described earlier on this page. Medical, rehabilitation and attendant care coverage stayed mandatory on every policy, and the auto insurer now pays those claims first, in full from the start, which leaves a family's own extended health or employer plan intact for everything else.

Where the policy carries it, the death benefit is paid as a lump sum to the surviving spouse and as a separate lump sum to each dependant. The amounts can be substantially higher where the deceased had purchased increased benefits, which we always check. Funeral benefits contribute to the immediate costs of laying your loved one to rest, again with higher limits on some policies.

Counselling for the family itself can come out of those same medical and rehabilitation benefits, but it is conditional, and we would rather set out the condition than let you count on it. The Schedule pays these benefits to an insured person who sustained an impairment in the accident. A relative who was not in the collision can still count as an insured person, but only if two things are true. That relative must be the named insured under a policy, a specified driver on it, or the spouse or a dependant of a named insured. The death must also have caused that relative a psychological or mental injury.

Where that is made out, psychological treatment and family counselling are claimed on a treatment plan, against that relative's own insurer, within the same coverage limit as any other medical and rehabilitation claim. Insurers do dispute these claims, so we tell each family where they stand before anyone relies on the money. Benefits the policy does provide are payable regardless of fault, they do not wait for the lawsuit, and they require applications on short timelines, which is why filing them is among the first things we do on every fatal file. They are not the compensation. They are the support that can carry a family until the compensation arrives, and we claim every one your family is entitled to.

Wrongful death in Ontario: what every grieving family should know

The framework matters, because insurers exploit families who don't know it.

  • Who can claim

    Under Part V of the Family Law Act, the deceased's spouse, children, grandchildren, parents, grandparents, and siblings each hold their own claim, assessed individually by relationship and loss. One lawsuit typically carries all of them, together with the estate's Trustee Act claim.
  • What can be claimed

    Loss of care, guidance, and companionship, which is the law's recognition of the relationship itself. Loss of financial support, the dependency claim, where the deceased provided income the family relied on. Loss of household services, meaning the childcare, caregiving, and home management the deceased performed. Expenses incurred for the deceased between injury and death. Travel and out-of-pocket losses. And funeral and burial expenses.
  • The honest truth about Ontario's awards

    Unlike the American verdicts families may have seen in the news, Ontario compensates loss of care, guidance, and companionship within ranges shaped by case law. Those ranges are meaningful but measured. Dependency and services claims carry no such ceiling, and for a lost breadwinner or caregiving parent they are usually the largest part of the claim by far. Building them properly, with actuarial and economic evidence, is where these cases are won.
  • No-fault death benefits in motor vehicle cases

    Since July 1, 2026 the death benefit and the funeral benefit are optional purchases. Where the policy bought them, the SABS pay a lump sum to the surviving spouse and to each dependant, plus a contribution to funeral costs. Where the policy did not, those two benefits are not available to the family. The same is true where the person who died was not that policy's named insured, spouse, dependant or listed driver, because the tightened eligibility rules apply to these two benefits as well. That is why one of the first things we do is read the certificate, the document issued with the policy that lists exactly what coverage was bought. Medical and rehabilitation coverage stayed mandatory on every policy. But the Schedule pays that coverage to an insured person who sustained an impairment in the accident, so counselling for a surviving relative is a claim with conditions attached rather than automatic support. Where no death or funeral benefit was bought, the family's recovery runs through the Family Law Act claim, not through the Schedule. Whatever the policy carries is payable regardless of fault, on short timelines, and separate from and in addition to the lawsuit.
  • Partial fault does not bar the family

    Under the Negligence Act, if the deceased bore a share of responsibility, the family's recovery is reduced by that share, not eliminated. Never let an adjuster's "he caused it" end the conversation.
  • Deadlines run through the grief

    2 years from the date of death for the lawsuit, with extra time allowed where the cause of death only becomes clear later, as in some medical cases. Insurance notice in as little as 7 days after a fatal collision. Benefits applications within 30 days of receiving forms. 10-day notice where a municipality is implicated. And evidence such as the wrecked vehicle, the camera footage, and the scene, measured in days.
  • Criminal or coroner proceedings do not pay the family

    Charges against the driver and coroner's inquests pursue accountability and answers, and we monitor and use them. But compensation flows only through the civil claim and the benefits. The processes run in parallel, and the civil file must stand on its own.

  • Who can bring a wrongful death claim in Ontario?
    Under Part V of the Family Law Act, the deceased's spouse, children, grandchildren, parents, grandparents, and siblings can each bring a claim. Each one is assessed by that relative's own relationship and loss. They are typically advanced together in one lawsuit, alongside the estate's Trustee Act claim. We coordinate every eligible family member's claim in one file.
  • How long do we have to file a wrongful death claim?
    The general limitation period is 2 years from the date of death, with extra time where the cause emerges later, as in some medical cases. The working deadlines are far shorter. Insurance notice after a fatal accident can be as short as 7 days, benefits applications run on 30-day timelines, and municipal notice can be 10 days. Contact us as soon as you are able, and every deadline becomes ours.
  • What compensation can our family claim?
    Loss of care, guidance, and companionship for each eligible relative, plus the dependency claim for loss of financial support, usually the largest where the deceased provided income. Add loss of household and caregiving services, expenses between injury and death, and funeral and burial costs. In motor vehicle deaths there is a separate no-fault SABS layer, and since July 1, 2026 it reads in two parts. Death benefits to the spouse and each dependant and funeral benefits are optional purchases, paid where the policy bought them and unavailable where it did not. Where they were not bought, nothing in the Schedule replaces them, and the family's recovery runs through the Family Law Act claim above. Medical and rehabilitation coverage stayed mandatory, and counselling can be claimed under it by a surviving relative who is an insured person under a policy and who has suffered a psychological injury from the death.
  • The insurer says the accident was partly our loved one's fault. Is the claim over?
    No. Under Ontario's Negligence Act, partial fault reduces the recovery by the deceased's share, but it does not eliminate it. And fault theories built against someone who cannot answer them deserve scrutiny, not acceptance. The reconstruction evidence we preserve answers on their behalf.
  • The driver is facing criminal charges. Do we still need a civil claim?
    Yes, you still need the civil claim. They are different processes with different purposes. Criminal proceedings punish, and they pay the family nothing. The civil claim and the benefits are where compensation flows, and a conviction, when it comes, powerfully supports the civil case. We monitor the criminal process and the coroner's work for you, and bring back what the claim needs.
  • What is a "dependency claim" and why does everyone say it matters most?
    It is the claim for the financial support the deceased would have provided across their working life, including income, benefits, pension, and career trajectory, calculated with actuarial and economic evidence. For a family that lost a breadwinner it is typically the largest component by far. For a lost caregiving parent, the parallel services claim of childcare and home management, valued at market cost, can be just as large. These are the claims insurers most underpay and we most carefully build.
  • Are Ontario wrongful death awards like the huge American verdicts we've seen?
    Honestly, no, and you deserve that honesty early. Ontario's care, guidance, and companionship awards are assessed within measured, precedent-shaped ranges. But the dependency and services claims carry no such ceiling, and for most families they are where the real recovery lies. A properly built Ontario claim is aimed squarely at a family's future needs. It simply gets there a different way than the American headlines suggest.
  • What does it cost, and can we afford this right now?
    Nothing upfront, ever. VC Lawyers works on a contingency fee basis with no fees unless we win, including all expert costs for reconstruction, actuarial, and economic evidence, which we fund as the case proceeds. The consultation is free, at your home if that's easier. And where the policy bought the SABS death and funeral benefits, we file them in the first days, so support reaches the family long before the claim resolves.
  • Our loved one was killed by a hit-and-run or uninsured driver. Is there still a claim?
    Yes, there is still a claim. The family's claims proceed through uninsured and unidentified motorist coverage on household policies, the OPCF 44R family protection endorsement (an optional add-on covering uninsured and underinsured motorist claims) where carried, and Ontario's Motor Vehicle Accident Claims Fund as a last resort. The no-fault death benefits the policy carries run alongside them. These claims have their own urgent technical requirements, and we handle them regularly.
  • The death happened at work. What applies?
    Workplace fatalities run through Ontario's workplace compensation system, which pays survivors under its own separate set of rules. Alongside it, your family may have third-party claims, meaning claims against others involved such as equipment manufacturers, other contractors, and drivers, and the Ministry of Labour may run its own proceedings. Where those third-party claims exist, your family may have to choose between claiming the workplace benefits and suing those third parties, and the law calls that choice an election. That choice, and the decisions about how the different claims fit together, matter enormously and must be made correctly from the start. We guide families through all of it.
  • How long will this take, and what happens with money for our children?
    Most wrongful death claims resolve in roughly two to three years, many at mediation, with dignity and without trial. We still prepare every file as if trial will come, because that preparation is what produces fair offers. Settlements involving children are court-approved and, where appropriate, structured, so the recovery is protected and arrives at the moments in their lives their parent was providing for.
