But there is a catch that makes hit and run claims a demanding practice. Because the paying insurer never gets to question the fleeing driver, the system demands more from the victim.
You must report the collision to police promptly, within 24 hours, and notify your insurer quickly. If you want more than the $200,000 statutory minimum on an unidentified-driver claim, you must also produce corroborating evidence, meaning proof from a source other than your own word, that the phantom vehicle (the unidentified vehicle that left the scene) existed and caused the crash. That proof can be an independent witness, physical evidence of the other vehicle, or camera footage.
Insurers actively look for reasons to deny or minimize unidentified-driver claims. They often suggest the victim invented the other vehicle or caused a single-vehicle crash. In *Alexander v Doe* (2018 ONSC 5882), the plaintiff said a phantom vehicle had rear-ended them. The physical evidence was inconsistent with that account, and it included 18 photographs showing no rear damage to the plaintiff's vehicle. The court dismissed the claim for unidentified motorist coverage on summary judgment, meaning without a full trial. A hit and run, legally a "fail to remain", occurs whenever a driver involved in a collision leaves without stopping, identifying themselves, and rendering assistance. Sometimes the vehicle is never seen again. Sometimes a partial plate, a paint smear, or a doorbell camera identifies it days later. Sometimes the driver is known but turns out to be uninsured, which Ontario law handles through the same coverage rules.
North York produces all of it: high-speed flights from collisions on the 401 and Allen Road, drivers fleeing struck pedestrians on the wide arterials of Finch and Steeles, sideswiped cyclists on Keele where the bike lane vanishes, and an endless stream of parked-car strikes in the plaza lots and apartment garages of Willowdale, Don Mills, and Jane and Finch.
Why drivers flee, and why it doesn't matter to your claim
Drivers run because they are impaired, suspended, uninsured, panicked, or driving someone else's car. The coverage ladder: where your compensation actually comes from
Rung 1: your own policy's Uninsured Automobile Coverage. Standard on every Ontario auto policy. For an unidentified or uninsured at-fault driver, your insurer stands in their place and answers your claim for pain and suffering, income loss, and other damages, to the statutory $200,000 baseline.
Rung 2: the OPCF 44R Family Protection Endorsement. The inexpensive endorsement most Ontario drivers carry without knowing it. It tops up recovery to your own third-party liability limits, commonly $1 million or $2 million, and extends to eligible family members, including when they are injured as pedestrians or cyclists.
The price of admission for unidentified-driver claims at these limits is corroboration: independent witness evidence or physical evidence of the phantom vehicle, with negligence proven on a balance of probabilities (meaning more likely than not). This rung is where serious hit and run claims are won, and where unrepresented victims most often fail.
Rung 3: household and priority policies. Pedestrians and cyclists with no policy of their own routinely have coverage through a spouse's or household member's policy, including its 44R endorsement. The priority rules are technical; we apply them so the claim lands on the best available policy.
Rung 4: the Motor Vehicle Accident Claims Fund (MVACF). Ontario's insurer of last resort, for victims with no recourse to any auto policy. The Fund provides accident benefits and answers lawsuits for unidentified or uninsured drivers, capped at $200,000, with strict notice requirements and the province acquiring recovery rights against the driver if found. Real protection, but the floor of the system, which is why we exhaust every higher rung first.
Running alongside every rung: Statutory Accident Benefits. No-fault benefits flow regardless of whether the driver fled, and three of them are mandatory on every Ontario policy, so no missing driver and no coverage choice can take them away. Medical benefits, rehabilitation benefits, and attendant care are yours. Since July 1, 2026 the auto insurer pays the medical side first as well, rather than your own extended health or employer plan.
That same reform made the rest of the package optional and narrowed who is eligible for it. Income replacement and non-earner benefits (benefits for people who were not earning an income when the crash happened and who suffer a complete inability to carry on a normal life) now depend on what coverage was bought on the responding policy, meaning the policy that has to answer your claim. Where income replacement was purchased, it still generally pays 70% of your gross income up to the policy limits. If your injuries meet the catastrophic impairment tier, which is Ontario's most severe injury classification under insurance law, you can claim up to $1,000,000 combined for medical, rehabilitation and attendant care. Wrongful benefit denials go to the Licence Appeal Tribunal (LAT), and we take them there.
