One critical piece of advice before anything else: do not give a statement to the at-fault driver's insurance company before speaking with a motorcycle accident lawyer. Insurers train their adjusters to extract admissions from riders in the confused, medicated days after a crash. Anything you say can and will be used to reduce or deny your claim.

Left-turning drivers. The single most common serious motorcycle crash in Ontario is the left-turn collision: a driver turning left across the rider's path at an intersection, claiming afterwards that they "never saw the motorcycle." Research into looked-but-failed-to-see errors shows drivers' brains routinely filter out narrow-profile vehicles. Legally, a left-turning driver who crosses oncoming traffic bears a heavy burden, and we hold them to it.

Lane changes and blind spots. On the 401, 404, and Allen Road, drivers drifting between lanes without shoulder-checking sideswipe riders or force them into barriers. Highway-speed crashes are among the most catastrophic we see.

Distracted driving. Inattentive driving was a factor in 66 Ontario road fatalities in 2024, per the provincial preliminary report. A driver glancing at a phone for two seconds at 60 km/h travels more than 30 metres blind. That is more than enough to miss a motorcycle braking ahead.

Speeding and aggressive driving. Speed-related collisions accounted for 155 deaths in 2024, a quarter of all Ontario road fatalities. Speed differentials are especially deadly to riders, who absorb collision forces with their bodies.

Following too closely. A rear-end tap that dents a car bumper can throw a rider from the saddle. Riders stopped at lights on Sheppard or Finch are particularly exposed.

Impaired driving. Alcohol- and drug-impaired drivers killed 55 people on Ontario roads in 2024. Riders struck by impaired drivers may also pursue aggravated and punitive damages in appropriate cases.

Poor road conditions. Potholes, gravel, construction plates, uneven pavement, and painted lines slick with rain pose hazards to two wheels that four-wheeled vehicles shrug off. Where a municipality failed to maintain the roadway, a claim against the city may be available. But notice deadlines for claims against municipalities are extremely short, as little as 10 days for written notice, making immediate legal advice essential.

Dooring and parking-lot incidents. In the dense commercial strips of Willowdale and North York Centre, doors opened into the curb lane without a shoulder check and vehicles backing out of plaza parking account for a steady stream of rider injuries.

Ontario runs a hybrid insurance system, and injured riders can typically pursue both tracks at once.

1. Statutory Accident Benefits (SABS), the no-fault stream. Anyone injured in a motorcycle accident in Ontario can claim accident benefits through the applicable automobile insurance policy, even if they caused the crash. Riders should know exactly which benefits survived the July 1, 2026 changes, because rider injuries are the ones that need them. Medical benefits, rehabilitation benefits, and attendant care stayed mandatory on every Ontario policy. A rider who comes home needing help to dress, bathe, and move has attendant care available whatever coverage was selected. Auto insurance now pays first for medical claims too, so the injured rider's own extended health or employer plan is no longer drawn down first.

The benefits that became optional purchases are income replacement (generally 70% of gross income up to policy limits), non-earner benefits, and the housekeeping and caregiver benefits. Two things now decide whether you get them. First, someone had to buy that coverage. Second, you have to be one of the people that policy covers: the named insured (the person the policy is in the name of), that person's spouse, a dependant of either, or a driver listed on the policy. If you are claiming on your own policy, that second condition is usually met. It matters far more if you were a passenger on someone else's machine, because you may fall outside that group no matter how much optional coverage the owner bought. Read all of this off the Certificate of Automobile Insurance rather than assuming. The optional coverage riders are most tempted to decline at renewal, income replacement above all, is the coverage that matters most in the months after a serious crash. Most injuries fall into capped benefit tiers. A catastrophic impairment designation, for example severe TBI, paralysis, amputation, or marked psychological impairment, unlocks up to $1 million combined for medical, rehabilitation and attendant care benefits, available for life. Case management is funded out of the mandatory medical and rehabilitation benefits once that designation is in place, so no optional purchase is needed for it, and housekeeping is the piece that has to have been bought. Insurers fight catastrophic designations hard. We fight back with medical-legal evidence, and we take wrongful denials to the Licence Appeal Tribunal (LAT).

2. Tort claim against the at-fault driver. If another motorist was fully or partially at fault, you can sue in the Ontario Superior Court of Justice for pain and suffering, past and future income loss, future care costs, housekeeping capacity, and out-of-pocket expenses. Family members may advance their own claims under the Family Law Act for loss of care, guidance, and companionship. Ontario has two rules that limit pain-and-suffering awards in motor vehicle cases: the statutory deductible, a fixed amount subtracted from that part of your award unless the award is large enough that the deductible no longer applies, and the verbal threshold, a legal test your injury has to meet before any pain-and-suffering money is awarded. Insurers use those rules to discount claims, and an experienced lawyer builds the claim around them.
