Here is the framework every injured Ontarian should understand. Your Ontario auto insurance follows you into the United States. Under a valid Ontario policy, you carry essentially the same protection in a collision in Niagara Falls, New York as in Niagara Falls, Ontario. That includes your liability coverage and, critically, your Statutory Accident Benefits (SABS) coverage.

The Ontario rules changed on July 1, 2026, and what stayed put is the anchor. Medical, rehabilitation, and attendant care are still mandatory on every Ontario policy, so a Canadian hurt in Buffalo or Fort Myers carries all three, along with the catastrophic impairment tier for the most serious injuries. Income replacement, non-earner, and the remaining benefits became optional purchases under narrowed eligibility, so those depend on the coverage you bought before you left. Auto insurance now pays first for medical claims as well, so your own extended health or employer coverage is no longer drawn down first. You claim all of it from your own Ontario insurer regardless of where the accident happened.

Meanwhile, your tort claim (civil lawsuit) against the at-fault driver typically proceeds in the U.S. state where the crash occurred, under that state's law. Each state sets its own limitation period: Florida two years, Michigan and New York three, California and Texas two, and so on. Each state also sets its own damages rules, often with no cap on pain-and-suffering awards. Ontario, by contrast, caps non-pecuniary damages (non-financial losses like pain and suffering) at roughly $470,000 (adjusted annually for inflation).

Run together properly, the two systems can produce a substantially better recovery than either alone. Run carelessly, they collide. If you settle the U.S. claim and sign the wrong release, which is the document the U.S. insurer asks you to sign to close that claim for good, you can destroy your Ontario underinsured coverage. You also generally cannot sue over the same loss in two courts.

There is one more layer that decides many of these claims: American insurance minimums. Many U.S. states allow drivers to carry liability limits that would be unthinkably low in Ontario, sometimes a few tens of thousands of dollars. Many American drivers carry nothing at all.

Cross-border injuries skew catastrophic. The three claims, and how they fit together

Claim 1: SABS, in Ontario, immediately. You file with your own Ontario insurer regardless of where the crash occurred. Medical, rehabilitation, and attendant care benefits are mandatory on every Ontario policy, so they are there for you whatever else you bought, and since the July 1, 2026 reforms the auto insurer funds the medical side first, ahead of your own extended health or employer plan.

Those same reforms moved income replacement (still generally 70% of gross income to policy limits where that coverage was bought) and non-earner benefits into the optional column, under narrowed eligibility, so what you draw on the income side depends on your policy. The catastrophic tier provides up to $1,000,000 combined for medical, rehabilitation and attendant care. This is the stream that funds your treatment and household now, while the tort claims develop. Disputes go to the Licence Appeal Tribunal, and we take them there.

Claim 2: the tort claim, usually in the accident state, under state law. Many states allow pain and suffering without Ontario's cap, deductible, or threshold. Economic damages follow state rules, and punitive damages are available where state law allows. We bring the claim with vetted state co-counsel, on state deadlines, using the evidence we started preserving in week one.

Claim 3: uninsured and underinsured, back in Ontario. Where the American driver was uninsured, underinsured, or unidentified, your Ontario policy's uninsured coverage and OPCF 44R endorsement respond, up to your own liability limits, through Ontario proceedings. The sequencing trap lives here. A U.S. settlement release signed without preserving this claim can extinguish it. That is why no release is signed in our files without the 44R analysis done first.

Running throughout: coordination. OHIP's limited out-of-country coverage, travel insurance, employer and private health plans, and long-term disability all interact with the claims above. Since July 1, 2026, auto insurance pays before your own health plan on medical claims. Offsets, subrogation (the insurer's right to recover from the at-fault party what it paid you), and elections between schemes are managed so the streams add rather than cancel.

The rules that govern these claims explain both the risk and the opportunity.

  • Your Ontario policy travels with you

    A valid Ontario auto insurance policy generally provides the same liability protection in the U.S. as at home. It also provides the same accident benefits coverage you actually purchased. That portability is the foundation of every cross-border recovery.
  • SABS is claimed in Ontario no matter where the crash happened

    Ontario's accident benefits are widely regarded as superior to most U.S. state no-fault schemes (systems where your own insurer pays your benefits regardless of who caused the accident). They flow from your own insurer for a Florida, Michigan, or New York accident exactly as for one on the 401. Medical, rehabilitation, and attendant care travel with you as mandatory coverage. Since July 1, 2026 income replacement and the other optional benefits depend on the policy you bought. The catastrophic impairment tier provides up to $1,000,000 combined for medical, rehabilitation and attendant care.
  • The tort claim usually runs under the law of the place of the accident

    Canadian courts apply the substantive law of where the crash occurred. A Florida crash is judged by Florida law even if procedural questions follow Ontario rules. Most cross-border tort claims are best brought in the U.S. state itself.
  • U.S. damages can be dramatically higher

    Ontario caps non-pecuniary damages, meaning pain and suffering, at approximately $470,000 (adjusted annually for inflation). It also applies a statutory deductible, an amount subtracted from a pain and suffering award, and a threshold, meaning the level of injury you must reach before you can be awarded pain and suffering at all. Many U.S. states impose much higher caps or none at all. That is one of the central reasons the forum question, meaning which jurisdiction's court decides your claim, matters so much.
  • State limitation periods vary and run fast

    Florida allows two years (recently reduced from four). Michigan and New York allow three. California, Texas, Arizona, and Nevada allow two, with shorter notice rules for claims against governments. The Ontario clock for SABS disputes and underinsured claims generally runs two years from denial under the Limitations Act, 2002.
  • U.S. insurance minimums are shockingly low

    Many states permit liability limits a fraction of Ontario's, and uninsured driving is common. That is why the OPCF 44R endorsement on your Ontario policy is frequently the largest single source of recovery in a serious cross-border file. It extends protection against uninsured, underinsured, and unidentified drivers abroad, for you, your spouse, and dependent children.
  • OHIP barely travels

  • I was injured in a car accident in Florida on vacation. Where do I file my claim?
    You will likely file multiple claims in different jurisdictions. A SABS claim goes to your own auto insurer in Ontario for accident benefits, regardless of where the accident occurred. A tort claim against the at-fault driver proceeds in Florida, applying Florida law. If the Florida driver's limits are inadequate, an Ontario underinsured (44R) claim follows. We file the Ontario side immediately, engage Florida co-counsel for the state side, and sequence all three.
  • Does my Ontario insurance even cover an American accident?
    Yes. A valid Ontario policy generally gives you the same protection in the U.S. as at home. That includes liability coverage and your accident benefits. Medical, rehabilitation, and attendant care stayed mandatory when the rest became optional purchases on July 1, 2026, so your care is covered abroad no matter what you selected. If you carry the OPCF 44R endorsement, it protects you, your spouse, and dependent children against uninsured, underinsured, and unidentified drivers abroad. Check your accident benefits options and your 44R before you travel, and claim under all of it after.
  • The American driver barely had any insurance. Is my claim worthless?
    No, the opposite is true, and this is the classic cross-border file. Many U.S. states allow liability minimums a fraction of Ontario's. Your recovery shifts to your own policy's uninsured coverage and 44R endorsement, up to your own limits, commonly $1 million or $2 million, through Ontario proceedings. The trap is the U.S. release: signed without preserving the Ontario claim, it can destroy exactly this recovery. Sign nothing first.
  • The U.S. insurer offered me their policy limits and a release. Should I take it?
    Not before the Ontario analysis. Tendered limits are often a fraction of your damages, and the release language determines whether your far larger 44R claim survives. We handle tendered-limits scenarios regularly. We accept the American money the right way, with the Ontario claim intact.
  • Are U.S. damages really higher than Ontario's?
    Often, substantially. Ontario caps pain-and-suffering damages at roughly $470,000 (adjusted annually for inflation) and applies a deductible of $47,913.01 and a threshold of $159,708.71 (2026 amounts indexed by the Financial Services Regulatory Authority of Ontario). Many states have higher caps or none, and some allow punitive damages Ontario rarely sees. That is one half of why forum matters. The other half is that Ontario's accident benefits are generally superior to state no-fault schemes, so the winning structure usually takes the best of both.
  • How long do I have? I've heard everything from one year to four.
    It depends on the state where you crashed. Florida allows two years (recently cut from four), Michigan and New York three, and California, Texas, Arizona, and Nevada two, with much shorter notice rules for government defendants. The Ontario SABS and underinsured clocks generally run two years from denial. If your accident was recent, you almost certainly still have time, but don't assume in either direction. We verify every applicable period in your first consultation.
  • Will OHIP cover my U.S. hospital bills?
    Only partially, and only sometimes. OHIP's out-of-country coverage is limited to modest emergency amounts, while U.S. billing runs to six and seven figures. The real sources of recovery are travel insurance, your extended health plan, SABS medical benefits, and the tort and 44R claims. We coordinate all of them against the billing.
  • Do I need an American lawyer too, and can I afford both?
    Usually yes for the state-side tort claim, and yes, you can afford both. We work with established U.S. counsel selected for your specific state and file, under co-counsel arrangements within one coordinated contingency structure. You do not pay stacked fees, and you get both halves of your claim instead of half.
  • I'm an American (or other visitor) injured in Ontario. Can you act for me?
    Yes, we act for visitors too. Those injured on Ontario roads face our system in mirror image: Ontario accident benefits obligations on their insurers, the deductible and threshold on tort claims, and election questions between schemes. We run the Ontario side and coordinate with your home-state counsel and insurers.
  • I was a passenger or pedestrian in the U.S., not driving. Do I still have Ontario coverage?
    Very likely yes. SABS and 44R protections follow the insured person, not just the car. They cover you, and under the 44R your spouse and dependent children, including as passengers and pedestrians abroad. On the SABS side, medical, rehabilitation, and attendant care are yours as mandatory coverage, while the optional benefits pay according to what was purchased. Many clients only learn this in our first meeting.
  • How much does a cross-border accident lawyer cost in North York?
