Who can be held liable for a North York truck accident?
This question separates truck cases from ordinary car crashes. Potentially responsible parties include the truck driver for negligent operation, and the carrier both vicariously for its driver and directly for its own negligence in hiring, training, supervision, scheduling, and maintenance. Add the vehicle's owner or lessor, third-party maintenance shops, shippers and loaders responsible for cargo weight and securement, freight brokers in some circumstances, and manufacturers of defective brakes, tires, or components.
Each party brings its own insurance: commercial liability, general liability, and umbrella or excess layers. Identifying every defendant and every policy is the single most consequential piece of work in a serious truck claim, because it determines how much compensation is actually available.
The deadlines here are shorter than most people expect.
Your two avenues of recovery under Ontario law
1. Statutory Accident Benefits (SABS), the no-fault track. Anyone injured in a motor vehicle collision in Ontario, including truck collisions, can access accident benefits through the applicable auto policy regardless of fault.
Two things about that track changed on July 1, 2026, and in a truck collision the difference is worth knowing early. Medical, rehabilitation and attendant care remain mandatory on every Ontario policy. That is the coverage that pays for the treatment and the day to day care these crashes make necessary. Income replacement, non-earner, caregiver, housekeeping, death and funeral, and the rest became optional purchases, and fewer people now qualify for them. Auto insurance also now pays first for medical claims, covering them in full from the start. That leaves your own extended health or employer health plan untouched and available for everything else.
A truck collision usually involves several insurers at once, so it is worth being clear about which one does what. Only one auto policy pays your accident benefits, no matter how many commercial policies stand behind the truck itself. Ontario's priority rules decide which policy that is. That one policy pays the mandatory benefits, and it is also the only policy whose optional coverage matters to you. Income replacement is still calculated at 70% of gross income, up to the policy limits. But it is paid only if that policy bought the optional coverage, and only if you are one of the people it now covers: the named insured, that person's spouse, a dependant of either, or a driver listed on it. That second condition hits passengers hardest. If you were riding in someone else's vehicle and have no policy of your own, you can fall outside that list even where the driver bought generous optional coverage. The carrier's commercial, general liability, and umbrella layers do not top up your benefits either way. They answer on the tort side.
Because truck-crash injuries are so often severe, the catastrophic impairment designation, which is the official Ontario auto insurance designation for the most severe injuries, matters enormously here. It unlocks up to $1,000,000 combined for medical, rehabilitation, and attendant care benefits, available for life. Because those three stayed mandatory, that limit is reachable on any policy. Once the designation is made, case management is paid out of the mandatory medical and rehabilitation benefits. That matters in a file that already involves several insurers, because no one can point to a missing optional purchase as a reason to avoid coordinating your care. Housekeeping is the one benefit that sits on top of that $1,000,000 limit, and only where the optional coverage was bought. Insurers resist catastrophic designations. 2. Tort claim against the at-fault parties. Where the truck driver, carrier, or another party was negligent, you can sue in the Ontario Superior Court of Justice. Case management is funded out of those mandatory medical and rehabilitation benefits, and needs no optional purchase, while housekeeping is the added benefit that depends on the coverage bought on the policy.
