Standard coverage has four parts. Title insurance in North York: what you need to know

Every property in North York carries a title history, and some carry surprises. There is the post-war Bathurst Manor home with the survey nobody updated since 1962, and the Willowdale rebuild with the old easement. There is the Flemingdon Park rental whose absent owner is exactly the fraud target the era prefers.

There is the Yonge-corridor condo with the gap between closing and registration, and the basement apartment whose permits were always a question. Title insurance exists for all of it, and the practice around it has two halves.

What an owner policy covers, and what it excludes

What owner policies cover. Fraud and forgery comes first, meaning transfers and mortgages registered against your title by impersonators, including events after closing, for as long as you own. Then come unknown liens and charges, such as the construction lien, the old mortgage never discharged, and the tax arrears that pre-dated you.

Next are encroachments and survey issues, such as the garage over the line discovered when the neighbour sells. Then public-record errors and hidden defects, including, in many policies, certain permit and compliance problems that surface as municipal orders. Then gap coverage. And finally defence costs, the funding of your title's legal protection, often the policy's most valuable promise.

What policies don't cover, and why it matters at claim time. Exceptions are scheduled on your specific policy. Matters you knew about and didn't disclose are excluded, as are losses from your own conduct. Then come the procedural teeth: cooperation duties, insurer approval of legal costs and settlements, and liability capped at the lesser of actual loss or policy amount.

Title fraud: the threat, and the response

How it works. Stolen identity documents and forged signatures let a fraudster "sell" your home to a straw buyer or, more commonly, register a fraudulent mortgage and vanish with the advance. The preferred targets are mortgage-free properties, tenanted homes, owners travelling or abroad, and estates. Victims typically learn from a mortgage statement, a default notice, or a land-registry alert for a transaction they never made.

The first 72 hours. Locate your title policy and notify the insurer properly, because the duty exists and so does the coverage, including, in comprehensive policies, fraud after closing. File the police report. Engage the land registry. Put the lender behind any fraudulent charge on notice. Alert the credit bureaus where identity theft is involved.

  • What does title insurance actually cover?
    An owner policy covers fraud and forgery, meaning transfers and mortgages registered by impersonators, including events after closing, for as long as you own. It also covers unknown liens and charges that pre-dated you, encroachments and survey issues, public-record errors and hidden defects, and in many policies certain permit and compliance problems. Add gap coverage between closing and registration, and, often most valuable, defence costs that fund the legal protection of your title. One premium at closing, typically a few hundred dollars residentially, buys lifetime coverage.
  • My lender required title insurance, so I'm covered, right?
    Probably not the way you think. The lender policy protects the lender's mortgage interest, meaning its loan, not your equity or your ownership. The owner policy is the one that protects you, and it is placed at the same closing for a modest additional premium. It is the single most common title insurance misunderstanding, and the cheapest one to fix, at closing if you're buying, or through an existing-owner policy if you already own.
  • I've owned my home for 20 years with no title insurance. Is it too late?
    No, it isn't. Existing-owner policies are available, with the fraud coverage that matters most for exactly your situation, because long-owned, often mortgage-free homes are the fraud era's preferred targets: clean title to borrow against, and no lender watching the file. For paid-off North York homes it is among the cheapest meaningful protections you can add, and we can place it without any transaction pending.
  • I just found out there's a mortgage registered on my home that I never took out. What do I do right now?
    Call us today. This is the file where days matter. We locate your title policy and notify the insurer properly, since fraud after closing is covered under comprehensive owner policies. We file the police report, engage the land registry, and put the lender behind the fraudulent charge on notice. Credit alerts follow where identity theft is involved. Then the court applications to discharge the forged instrument and restore your title move urgently. Don't negotiate with anyone connected to the charge, and don't make these calls alone.
  • Does title insurance cover fraud that happens years after I bought?
    Yes. Comprehensive owner policies cover both pre-existing defects and future events, including a fraudulent transfer or mortgage registered years after closing, for as long as you own the property. It is precisely why the product matters in the fraud era, and why existing-owner policies are worth their premium on long-held homes.
  • The title insurer denied my claim, citing an exclusion. Is that final?
    No. "Final" is what insurers call positions that haven't been tested. Title policies are insurance contracts, so the complete policy governs, meaning schedules, endorsements, and exceptions rather than the brochure. Ambiguous wording is construed against the insurer that drafted it, and the duty of good faith binds the handling. Ontario courts, up to the Court of Appeal, have resolved title-coverage fights in insureds' favour on exactly this kind of wording. Bring us the policy and the denial, because you generally have two years from the denial to sue.
  • The insurer accepted coverage but everything moves at a crawl, with legal costs approved in fragments and no resolution in sight. Normal?
    Common, and contestable. Defence coverage honoured in principle but metered in practice is a handling problem with legal answers: the policy's defence obligation enforced, timelines pressed, and good-faith exposure raised where the metering becomes constructive denial. A title claim run as funded litigation still has to actually fund the litigation. Managing the insurer is part of managing the claim, which is why represented insureds fare differently.
  • A claim came up and the insurer wants to "remove the cause" rather than pay me. Can they choose?
    Generally yes, because the policy typically gives the insurer options: defend the action, remove the cause of the claim, negotiate, settle, or pay, exercised under the policy's terms. The options are theirs. Protecting your interests inside them is ours. We make sure the chosen path actually restores your title and your position, that the costs are properly carried, and that "removal" doesn't quietly leave you worse off than payment would have. Don't navigate the options letter alone.
  • What's the difference between what my lawyer does and what title insurance does?
    They are complements, not substitutes. Your lawyer's searches, requisitions, and diligence prevent the problems that are findable. Title insurance backstops the ones that aren't: the forged document, the hidden lien, the fraud that arrives in year twelve. A careful closing needs both, which is exactly how we run ours. A contested claim then needs the lawyer again, this time reading the policy against the insurer.
  • Do my cooperation duties continue while I'm disputing the insurer's position?
    Generally yes, and strategically, absolutely, because non-cooperation hands the insurer a second, cleaner denial. The practice is cooperation under protest: duties met, documents provided, and positions reserved in writing, while the coverage dispute runs on its own track. We manage both tracks together so neither one damages the other.
  • What does this cost?
    It depends on the matter and the situation. Transactional placement is quoted as part of the closing work, in writing, before it starts. Fraud response and contested claims are scoped to the file's complexity, with the fee arrangement confirmed in writing before we act, and the consultation itself is billed. The protection should never cost more than the risk, and with us it doesn't.
  • Do you handle title insurance matters outside North York?
    Yes. We handle placement, fraud response, and coverage litigation across the GTA and Ontario, for any property in the province. Meet us in person at our Finch Ave W office, or by video wherever you are.
