Residential real estate in North York: what you need to know

North York's housing map is the GTA in miniature. There are the condo towers stacked along the Yonge corridor from Sheppard to Finch, and rising at Sheppard and Don Mills. There are the post-war family streets of Bathurst Manor, Clanton Park, and Downsview, and the estates of York Mills and the Bridle Path's edges.

Then come the townhouse infill everywhere between, the investment units ringing York University, and the pre-construction cranes that never leave the skyline. Every one of those property types closes through the same legal process, and each carries its own checkpoints.

The transactions, plainly

Buying a home. The Agreement is reviewed, ideally before signing, since the conditions on financing, inspection, and status certificate are your protection and their deadlines are real. Title is searched and requisitions raised, off-title searches are run, and title insurance is placed. The lender is satisfied. Both land transfer taxes are calculated with every rebate you qualify for, adjustments are verified, funds move through trust, the transfer and charge are registered, and the keys are released. Selling a home. The mirror image. Your existing mortgage and any secured lines are ordered for payout. The buyer's requisitions are answered, and undertakings are given and honoured. Refinancing and private lending. On bank refinances, new lender instructions are executed and old charges discharged. Selling with a mortgage, selling with tenants: the seller-side wrinkles

Two seller scenarios deserve their own paragraph, because they generate most seller-side stress. Take selling with a mortgage, or several. Your existing charge, secured line of credit, and any private second all get paid out from closing proceeds. Payout penalties on fixed-rate mortgages can be substantial, so we order payout statements early and put the real net-proceeds number in front of you before closing week, not on it.

We then follow the discharges through to registration, so every mortgage, credit line, or private loan you have paid off actually comes off your title. That is an undertaking, a binding promise, and we track it until the title is clean. That matters because a charge that stays registered after the debt behind it has been paid out will stop your next sale, and someone then has to chase the discharge out of a lender that archived the file long ago.

Now take selling, or buying, a tenanted property. Ontario's tenancy rules stay with the unit, not the owner. That means the buyer takes on the existing tenant, the lease, and the current rent. The main exception is a valid purchaser's-own-use notice, which the seller serves on the tenant on the buyer's behalf when the buyer, or the buyer's spouse, child, or parent, genuinely intends to move in. Those notices carry strict timing and good-faith requirements, and cutting corners on them leads to real litigation.

Whether you're the seller promising vacant possession or the buyer counting on it, the clause, the notices, and the timeline need a lawyer's hand early. Vacant-possession failures are among the most common closing-day crises in the GTA, and almost all of them were preventable in the drafting.

Closing costs, demystified

The purchase price is the headline. The closing costs are the fine print every buyer should budget. Land transfer taxes are the big one, provincial plus Toronto municipal, with first-time buyer rebates against both.

Then come our legal fees, plus disbursements, meaning the out-of-pocket costs we pay on your behalf, such as title search and registration fees.     Signing and closing preparation

  • Do I really need a lawyer to buy or sell a home in Ontario?
    Yes, and it is how the system works. Every Ontario residential closing runs through a lawyer, who searches and certifies title, satisfies the lender's instructions, moves funds through statutory trust accounts, and registers the transfer and mortgage. The real question is when to involve one, and the answer is early, before signing where possible. The Agreement review that takes an hour prevents the problems that take months.
  • What will it actually cost, and what are "closing costs"?
    Your legal fees from us are quoted in writing up front and matched to the transaction, with disbursements estimated honestly. Beyond legal fees, budget for land transfer tax, because in North York you pay both the provincial and Toronto municipal LTT, typically totalling roughly 3 to 4% of the price, with first-time buyer rebates against both. Add title insurance, lender and appraisal fees, and adjustments, meaning your prorated share of prepaid property taxes, condo fees, and utilities. We put real numbers on your specific transaction in the written quote, so cash-to-close is never a surprise.
  • I'm a first-time buyer. What rebates do I get?
    Meaningful ones. First-time buyer rebates exist against both the Ontario and Toronto land transfer taxes, claimed at registration. Federal and provincial programs may apply too, including HST new-housing rebates on qualifying new builds, depending on your purchase. Eligibility has rules: prior ownership anywhere counts against you, and spousal history matters. Claiming correctly is your lawyer's job, so we confirm what you qualify for and file it right.
  • What is a status certificate and why does everyone insist I wait for it?
    It is the condo corporation's full disclosure package: budget and finances, reserve fund health, special assessments past and brewing, litigation, insurance, and the rules that will bind you. You're buying a share of a building's future, and a corporation with a starving reserve fund or a looming assessment is a cost you'd inherit at closing. We review it within your Agreement's window and give you a plain-language verdict before you waive the condition. Never waive on a skim.
  • I'm buying pre-construction. What should I know before the ten days run out?
    That the agreement was drafted entirely by the builder, and the ten-day cooling-off period is your one window of leverage, so have it reviewed now. We check deposit structure and protection, and caps on development charges and levies, the adjustments that otherwise inflate your final closing by tens of thousands. We check HST and rebate treatment, assignment rights, occupancy-fee mechanics, and timelines, then advise what to negotiate while you still can. Pre-construction rewards exactly one buyer: the one who read it in week one.
  • What's the difference between interim occupancy and final closing on a new condo?
    It is two-stage ownership. At interim occupancy you get the keys and move in, but you don't own yet, and you pay the builder monthly occupancy fees until the building registers. At final closing, title transfers, your mortgage starts, and the builder's statement of adjustments lands. That statement is the document where uncapped charges hide, and the one we scrutinize line by line.
  • What does a refinance involve, and how fast can it close?
    It is leaner than a purchase. Your new lender's instructions are executed, title is brought current, your existing charge is paid out and discharged, and funds are advanced through trust. With your documents in order and the lender responsive, refinances close quickly, and we'll tell you the realistic timeline on your facts at the quote stage. Private and second mortgages take the same care with extra documentation discipline, on both sides of the loan.
  • I want to add my spouse to title, transfer the house to my kids, or deal with title after a death. Is that complicated?
    Each is routine when done right and expensive when done wrong. Spousal additions and removals interact with your mortgage, since the lender must consent, and with family-law realities. Gifts and transfers to children carry tax and creditor questions worth answering before registration. Survivorship applications move title to the surviving joint owner after a death with the right documentation. Bring us the goal, and we'll map the route and its consequences first.
  • What is title insurance and do I actually need it?
    It is a one-time policy protecting against title defects, survey and zoning issues, certain closing errors, and, most relevantly in today's GTA, title fraud, where impersonators sell or mortgage homes they don't own. It is modest in cost, lenders typically require it, and in the fraud era we place it on every purchase and refinance as a matter of course. Inexpensive protection for the biggest asset you own.
  • What happens on closing day, exactly?
    From your side, very little, and that's the point. Behind the scenes, we and the other side's lawyer exchange closing funds and documents through trust, undertakings are confirmed, and the transfer and mortgage are registered electronically. Balances are paid where they're owed and keys are released, typically with a call or message from us that it's done. The drama, if any, happened weeks earlier in the diligence. Closing day done right is quiet.
  • Can everything be done remotely?
    Almost all of it. Documents move electronically, registration is electronic, and video signing is available where the file suits it. In-person appointments are available at our Finch Ave W office, with parking and TTC at Finch West Station, for those who prefer them. Tell us your constraints, and the process flexes.
  • Do you handle transactions outside North York?
    Yes. We close residential transactions across the GTA and Ontario. The property can be anywhere in the province, while you sign here, at home, or by video. North York is our base, not our boundary.
