Start with what probate actually is. When someone dies, their executor usually needs the court's stamp: the Certificate of Appointment of Estate Trustee. The court issues it "with a will" where there is a will, and "without a will" where there is none. The institutions holding the assets demand it. Banks won't release accounts, and the land registry won't transfer the house out of the deceased's sole name, without proof of the executor's authority.

The executor's job, and the liability behind it

To obtain it, we file the application correctly, put a value on the estate, and see that Ontario's estate administration tax is paid on that value. Then the real work begins. We find and secure the assets. We identify the debts and taxes and pay them in the right order, and we obtain the CRA's clearance certificate, the Canada Revenue Agency's confirmation that the estate's taxes are settled, before the final distribution. We keep beneficiaries informed, we keep meticulous records, and the estate is distributed exactly as the will directs, or as Ontario's intestacy law directs where there is no will.

Here is the sentence every new executor should hear before anything else: executors are personally liable for their mistakes. Distribute before a creditor or tax debt surfaces, miss a dependant's claim, sell an asset badly, or fail to keep accounts a court would pass, and the shortfall can come out of the executor's own pocket, regardless of good intentions.

Being named executor is an honour, and it is also a legal job most people have never trained for. Our administration practice exists so they never do it unprotected. The application and the tax

To get the Certificate of Appointment, we prove the will is valid and put a value on the estate. That value sets Ontario's estate administration tax, which is filed and can be confirmed later. This is where any planning the deceased did, meaning dual wills (a second will covering assets that do not need probate) and beneficiary designations, either paid off or didn't.

The duties, and the liability

The executor holds a position of legal trust: even-handed between beneficiaries, prudent with assets, accountable in records. The standard traps are well known. The first is distributing early. Where the creditor, the tax bill, or the dependant's claim surfaces after the money is gone, the shortfall is personally repayable. The second is skipping the CRA clearance.

Then there are accounts kept loosely, which are challenged at a passing of accounts (the court's formal review of the executor's financial records) where every entry needs a receipt. There is the estate home sold informally among family. And there is the silence toward beneficiaries that turns delay into suspicion, and suspicion into litigation.     Yes, executors can be paid. Executor compensation is recognized in Ontario, conventionally benchmarked against the estate's value and the work done. It is approvable by beneficiary agreement or by the court on a passing of accounts. It is also one of the most commonly disputed items in estate accounting, which is another argument for the meticulous records we keep from day one.
  • How long does probate take?
    A straightforward estate usually takes months, moving through the application, the tax, the clearance, and the distribution.   • The deceased had property or heirs outside Canada. Does that change things?
